TERMS AND CONDITIONS FOR THE HAUS WEBSHOP

1. General information

These terms and conditions apply to all purchases of goods made on the website at www.haus.dk, owned and operated by:

When you place an order in our webshop, you automatically consent to our terms and conditions for such webshop purchases. The terms and conditions are also available on our website or you can request a copy by sending us an email at info@haus.dk.

 

2. Orders

When you place an order in our webshop, you will automatically receive an email reply stating all order details, such as the orderer's name, address, delivery address, telephone number, email address, payment method and a list of the goods ordered. This email reply merely constitutes an electronic receipt acknowledging your order and, at this point, you have not yet concluded any legally binding purchase agreement with us. We recommend that you read the order receipt carefully and let us know if the details stated do not tally with the order you have made with us.

You will not have concluded a binding agreement until you receive an email from us confirming your order. Until this email confirmation reaches you, we are entitled to cancel your order in whole or in part owing to, say, incorrect price tags, information or typos, or as a result of goods out of stock. If this is the case, we will of course notify you by email.

Before reaching the step where you submit your final order, you will be presented with an overview stating the total price of your order, including shipping cost and any other fees/costs, if relevant. You will also be able to correct any errors made in your order.

Although we save your order details, they will not be available to you – except for the order confirmation – once you have submitted your final order. Therefore, we recommend that you download or save a copy or print the order confirmation.

You are responsible for and bear any risk involved with the contact information, including delivery address, being correct. 

Upon shipping your order, we will send you an invoice by email.


3. Pricing, shipping costs and payment

The current price of your order is the one stated for the relevant goods on our website on the day the order was submitted. Goods are invoiced in Danish kroner (DKK) and all prices, fees and costs are also stated in DKK on our website, in our order confirmation and invoice.

If you have earned a quantity discount and afterwards regret part of your purchase, which means that you no longer meet the criteria for earning such quantity discount, you will no longer be eligible for the value of the discount.

Unless otherwise stated in respect of a given product, all prices stated are inclusive of VAT, fees and charges.

Customers are offered free shipping for orders of DKK 600 or more.
Orders up to DKK 600 are subject to a shipping fee of DKK 65. 

For international shipping of orders, please send your request at info@haus.dk and we will get back to you with a pricing quote for shipping.

We accept payment by Dankort, Visa/Dankort, Mastercard and MobilePay. Your card account will not be charged until your order has been shipped.
Payments effected via our website are managed by QuickPay.

We will charge you for your order once it enters the shipping process. In other words, shipping is subject to sufficient funds on your debit or credit card – otherwise, in the event of insufficient funds on your card, the goods will not be shipped.

Late payment, say, the funds in your card account are insufficient to cover the invoice amount, or you stop the payment process or demand that it be reversed in an unlawful manner, is subject to a reminder fee of DKK 100 for each reminder. However, you will receive no more than three reminders before we refer the matter to debt collection.

Pursuant to the relevant rules applicable in the Danish Interest Act (renteloven), default interest will be added as from the due date until payment is made. We reserve the right to stop shipping of your order in the event of insufficient cover in your card account.

 

4. Delivery of order

Delivery takes place at the address stated by you as the delivery address. Shipping will be handled by a recognised shipping provider in the manner stated in your order and verified in our order confirmation.

The expected time of shipping is stated in the order confirmation.

As we are in no position to guarantee when exactly your order is ready for delivery and since vi do not control local delivery services, we cannot tell you for sure when your order will be delivered at your home address.

We will always notify you by email as soon as possible if the shipping of your order is delayed.


5. Right of cancellation

If you change your mind about your order, you have a right to cancel it within 14 days of receipt and get a full refund. If you want to exercise your right of cancellation, you must notify us within 14 days of receipt of the goods ordered, stating that you want to cancel your order. You must notify us by email or by completing and submitting this cancellation form and either way you must clearly state that you want to exercise your right of cancellation.

Simply refusing delivery of your order will not be deemed to be a cancellation. 

If you exercise your right of cancellation, you must return the goods delivered without undue delay and within 14 days of having notified us that you want to cancel your order. You must pay the shipping costs for returning the goods. You will bear the risk of the goods from the date of delivery until we have accepted their return delivery. Please make sure that you enclose the original or a copy of the order confirmation, invoice or similar documentation with the returned goods.

You bear the risk of the return goods being properly packed, which is why we recommend that you keep the original packaging until you are sure that you want to keep the goods.

Owing to their nature, some goods cannot be returned by ordinary postal delivery services. Given our wide range of various goods, we recommend that you contact us for pricing details of return shipping.

We do not take delivery of packages that are not delivered at our address or packages sent cash on delivery.

Orders exempt from the right of cancellation

Goods made to your specification or personalised goods are NOT covered by the right of cancellation.

The state of returned goods

You will be held liable for any diminution of the goods' value owing to their being handled in a manner other than what is necessary to determine its nature, properties or the way it works. In other words, you may test the goods as you would be able to do in a retail store, but you are not entitled to start using them.

If the goods have been tested to an extent beyond what has been described above and, as a result, have impression marks, scratches and/or been damaged, we will deem the goods to have been used, which means that, on cancelling your order, you will be refunded only part of or nothing of the purchase price depending on the retail value of the goods after the diminution of value has been deducted from the original purchase price.

Refund

You will receive a refund of the purchase price you paid, including shipping costs, upon return of the goods. In the event of the value being diminished, as described above, for which you are liable, any such diminution will be deducted first from the purchase price before a refund is made.

The amount will be credited to the designated bank account within 5 to 14 workdays.

We are entitled to retain the refund amount until we have received the returned goods unless you have already produced documentation of their return shipment.


6 Errors and defects – warranty

General

Where available, product descriptions and user manuals will be delivered with the goods, and you are requested to read the user manual before you start using the goods and to take the advice given on how to maintain the goods.

We recommend that you inspect and examine the goods immediately upon receipt, such as check them for damage and verify that they match your order.

24-month warranty period for all goods

All goods sold are subject to a 24-month warranty period. Accordingly, you cannot file a complaint about defective goods later than 24 months after you accepted their delivery.

Claims about faults and defects in the goods received must be filed in reasonable time after such faults and defects were detected or should have been detected. If you file a complaint within two months of detecting a defect, your complaint will always be timely.

The warranty applies solely to faults and defects that already existed in the goods at the time of delivery and not to faults and defects, including wear and tear, caused by incorrect use contrary to the user/maintenance manual or damage to the goods after you accepted their delivery.

Complaints about and return of goods

The returning of faulty or defective goods, including for the purpose of repair work or replacement, will be for our account but at your risk, which is why we recommend that you always take care to pack the goods properly on returning them. When you return the goods, you must specify the nature of the relevant fault or defect, and we recommend that you enclose a copy of the order confirmation and/or the invoice.

Return goods or claims under the warranty must be made to the address stated in clause 1), and the returning of goods should always be made subject to prior agreement with us so that we will be able to take care of your complaint in the best possible manner.

Repair work and replacement.

Generally, having detected that the goods are faulty or defective and having filed a timely complaint, you may:

  1. claim remedy of defects,
  2. claim delivery of substitute goods that are in conformity with the contract (replacement),
  3. claim an appropriate reduction of the price, or
  4. declare the contract terminated unless the lack of conformity is immaterial.

You cannot claim remedy or replacement if this is not possible or it will inflict disproportionate costs on us.

If we offer you remedy or replacement, you cannot claim a reduction in the price or termination of the contract.

We are obliged to meet a claim for remedy of faulty and defective goods within reasonable time. If we fail to do so, you may claim an appropriate reduction of the price, declare the contract terminated or claim replacement.

If remedy is not feasible, we will instead refund you the purchase sum, including any of your documented expenses incurred for returning the goods.

Liability

In no circumstance will we be liable for any indirect losses or consequential losses.

8. Right to complain

If we cannot reach an agreement on the outcome of your complaint, you may submit a complaint to the Danish Complaint Resolution Centre at Nævnenes Hus, Toldboden, 8800 Viborg, Denmark. You may either submit your complaint using the form at https://naevneneshus.dk/ or visiting the European Commission's online dispute resolution portal at http://ec.europa.eu/consumers/odr/ .
